Athlete Platform Agreement

1. Introduction

Welcome to Contested. This Athlete Platform Agreement ("Agreement") governs your use of the Contested platform as an athlete user. By creating an account and using our services, you agree to be bound by these terms.

2. Eligibility

To use the Contested platform as an athlete, you must:

• Be at least 18 years of age, or have parental/guardian consent if under 18
• Be currently enrolled as a student-athlete or have active athletic status
• Have the legal right to enter into this Agreement
• Comply with all applicable NCAA, conference, and institutional NIL policies

3. Account Responsibilities

As an athlete on the Contested platform, you are responsible for:

• Maintaining accurate and up-to-date profile information
• Keeping your account credentials secure and confidential
• All activities that occur under your account
• Notifying us immediately of any unauthorized access

4. NIL Rights and Opportunities

Contested provides a platform for athletes to connect with brands for Name, Image, and Likeness (NIL) opportunities. You acknowledge that:

• You retain all rights to your name, image, and likeness
• You are solely responsible for ensuring compliance with applicable NIL laws and regulations
• Contested does not provide legal advice regarding NIL compliance
• You must obtain all necessary approvals from your institution before engaging in NIL activities

5. Platform Fees and Payments

Contested charges a platform fee for facilitating NIL opportunities. You agree that:

• Platform fees will be clearly disclosed before you accept any opportunity
• Payments will be processed according to the terms of each individual agreement
• You are responsible for all applicable taxes on income earned through the platform
• Contested is not responsible for disputes between athletes and brands regarding payment

6. Content and Conduct

You agree to:

• Provide accurate information about your athletic achievements and social media metrics
• Not misrepresent your capabilities or influence
• Fulfill all commitments made to brands through the platform
• Conduct yourself professionally in all interactions
• Not use the platform for any illegal or unauthorized purposes

7. Intellectual Property

You grant Contested a limited, non-exclusive license to use your name, image, and likeness solely for the purpose of:

• Operating and promoting the platform
• Displaying your profile to potential brand partners
• Creating marketing materials featuring platform success stories (with your consent)

8. Compliance and Disclosure

You are responsible for:

• Disclosing NIL activities to your athletic department as required
• Ensuring all sponsored content complies with FTC guidelines
• Maintaining eligibility requirements for your sport
• Adhering to all institutional, conference, and NCAA policies

9. Termination

Either party may terminate this Agreement at any time. Contested reserves the right to suspend or terminate accounts that violate these terms or engage in fraudulent activity.

10. Limitation of Liability

Contested provides the platform "as is" and makes no guarantees regarding NIL opportunities, payment amounts, or brand relationships. We are not liable for any disputes between athletes and brands.

11. Changes to Agreement

We may update this Agreement from time to time. Continued use of the platform after changes constitutes acceptance of the updated terms.
